RESIDENTIAL RENT INCREASES CAPPED AT 1 PER YEAR

Under the recent changes to the residential tenancies act, introduced in 2020, we have to abide by very specific instructions regarding rent increases.

 

We MUST provide a minimum 60 days notice to the tenant of the rent increasing (41.1a&1b)

We can write an increase into a new lease, so long as the tenant is provided with a minimum of 60 days notice for the increase (41.2 note)

We are not allowed to increase the rent more than once in every 12 months (41(1B) & 42(2A))

 

It is important that you as the landlord keep these things in mind, so that when you are having a discussion with our office about rent increases, that these are the laws that we need to stick by.
